Welcome to MinkMe. This page states the Terms of Use (“Terms”) under which you may use MinkMe (www.minkme.org) site and its services. Please read them carefully before using this site and/or any applications or services available from it.
AGREEMENT
This is an agreement between Indian Mesh Private Limited (“Indianmesh.com”) a corporation, MinkMe a product of Indian Mesh Pvt Ltd, the operator of www.minkme.org, and the users accessing MinkMe services and its site.
By subscribing to and/or using any of our services you agree that you have read, understood and are bound by these Terms, regardless of the way you subscribe with us. If you do not want to agree to the Terms, you must not subscribe to and/or use MinkMe services. By accepting the Terms and Conditions set forth by Indian mesh and its product MinkMe, you give us the consent to hold your personal information and other data provided by you and/or uploaded through our services, which will be kept confidential until notified by its usage. The same will apply to all users whether residing within India or outside India.
You agree that MinkMe reserves the right, in its sole discretion, to terminate the access to any or all MinkMe websites or the application and the related services or any portion thereof at any time, without notice, for general maintenance or any reason what so ever.
MODIFICATION OF THESE TERMS OF USE
MinkMe may revise these Terms at any time by posting an updated version on this webpage. You are advised to visit this page time to time to review the most updated Terms as you are abiding by the same.
DELAY IN SERVICES
Neither MinkMe (including its owner and directors, employees, affiliates, agents, representatives or subcontractors) shall be liable for any loss or liability resulting directly or indirectly from delays or interruptions due to electronic or mechanical equipment failures, telephonic interconnect problems, defects, weather, strikes, walkouts, fire, acts of God, riots, armed conflicts, acts of war, or any other causes beyond its control.
ONUS OF THE USER

The User represent and confirm that the User is of legal age to enter into a binding contract and is not a person barred from availing the services under the laws of India or other applicable laws.
In consideration of your use of MinkMe site and/or MinkMe applications, you agree to provide true, accurate and complete information about yourself as prompted during the registration or its ordering process. You agree to update that information in order to maintain its truth, accuracy and completeness.
You will select a MinkMe pass-code for completing the MinkMe registration process after which a Mink ID would be generated and provided to you. You are responsible for maintaining the confidentiality of the pass-code and the account, and are fully responsible for all activities that occur under your Mink ID. If you suspect that someone may have obtained unauthorized access to your account, contact MinkMe and/or Indianmesh immediately to authorise MinkMe to deny such access to your profile.
In order to access and use MinkMe, you acknowledge and agree that you will have to provide MinkMe with your mobile phone number(s) and your SIM number. You hereby permit MinkMe to access your contact list and/or address book for phone numbers in order to provide and use the service. MinkMe may periodically access your contact list and/or address book on your mobile device to find and keep track of phone numbers of other users that are using MinkMe as well.
MinkMe indulges in user authentication, but because user authentication on the Internet is difficult, MinkMe cannot and does not confirm that each user is who they claim to be.
A
A. You acknowledge and agree that you are solely responsible for the content and accuracy of any material contained and transmitted by you on MinkMe. No advice or information, whether oral or written, obtained by you from MinkMe shall create any legal implications not expressed or stated herein. You are solely responsible for the “moods” updates that you submit which are displayed for your Mink ID. “If you don’t want the world to know something, don’t put it out there for others to see”. Profile details including photos, gender, and number of friends connected with, number of groups subscribed to, and mood submissions may be globally viewed by MinkMe users that have your mobile phone number on their smart phones and are connected with you through your Mink ID, except to those MinkMe users who have been removed by you.
MinkMe allows you to share files & photos, messages, join groups, view profiles and update “mood” statuses but you understand that all of your information, text, data, graphics, photographs, messages and other materials of any nature that are transmitted to or via MinkMe is the sole responsibility of the user from whom the materials are originated.You agree that your use of the MinkMe service shall be at your sole risk. In no event shall MinkMe, its officers, directors, employees, or agents, be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages what so ever resulting from any (1) Error, mistakes, or inaccuracies of content; (2) Personal injury or property damage of any nature what so ever, resulting from your access and use of our service; or (3) Any unauthorized access to or use of our secure servers and/or any personal information and/or financial information stored therein.

You agree not to use or launch any automated system that access the Service in a manner that sends more request messages to the MinkMe servers in a given period of time than a human can reasonably produce in the same period by using MinkMe application. You are forbidden from ripping the contents unless specifically allowed. You agree not to collect or harvest any personal identifiable information, including phone number, from the service, nor to use the communication systems provided by the service for any commercial solicitation or spam purposes. You agree not to spam, or solicit for commercial purposes, any user(s) of the service.
C “Chatter” (“Messages, photos, drawings and files”) and location data that you send directly to other MinkMe users will only be viewable by the recipients. You, and not MinkMe, are entirely responsible for the materials you transmit through the application.
You shall not create a services screen name or distribute through or otherwise publish through MinkMe services any materials which are indecent, libellous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, harassing, contain expressions of hatred, racism, or are otherwise objectionable, and/or that would constitute or encourage a criminal offense, violate the rights of any party and/or violate any law set forth.
Your materials shall not infringe the copyright, trademark, privacy right(s) or other intellectual property right(s) of MinkMe and/or Indian mesh services or any other organisation.
You shall not upload to, distribute through or otherwise publish through MinkMe services any materials that contain viruses or any other computer code, corrupt files or programs designed to interrupt, destroy or limit the functionality or disrupt any software, hardware, networks, servers or other equipment.
You agree and undertake that when using the MinkMe services you will not download any file posted by another user and/or distribute it without the consent of the user it originated from.
You acknowledge that MinkMe does not pre-screen any data posted by you or other users and that MinkMe and its team will have the right in their sole discretion to refuse and/or remove any data, and/or terminate the account of any user.
D
You are prohibited from violating or attempting to violate the security including without limitation, the following activities: (a) accessing data not intended for you or logging into a server or account which you are not authorized to access; (b) attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization; (c) attempting to interfere with the service given by MinkMe to any user, host or network via means of submitting a virus to the site, overloading, flooding, spamming and/or crashing; or (d) forging any TCP/IP packet header or any part of the header information in any email or newsgroup posting.
Violations of system or network security may result in civil and/or criminal liability. MinkMe can investigate occurrences which involve such violations and may involve and cooperate with law enforcement authorities in prosecuting users who are involved in such violations.
E
You shall provide and maintain all telephonic/internet and other equipment necessary to access MinkMe application, and the costs of any such equipment and/or telephone/internet connections or use, including any applicable taxes, shall be borne solely by you. You are responsible for operating your own equipment used to access MinkMe application.
INDEMNIFICATION
You shall indemnify, defend and hold harmless MinkMe and its associated entities from any and all actions, criminal or civil in nature, claims and losses imposed on, incurred by or asserted as a result of or related to a) your access and use of MinkMe application b) any non-compliance by you with the terms and conditions hereof, or c) any third party actions related to users receipt and use of the information, whether authorized or unauthorized d) or any other reason whatsoever.
WARRANTY AND REPRESENTATION
You certify that you are the person responsible for the content which you submit, or are otherwise authorized to use the content, and that the content does not infringe upon the property rights, intellectual property rights or any other rights of others.
You further certify that no action, suit, proceeding, or investigation has been instituted or threatened relating to any content, including trademark, trade name service mark, and copyright formerly or currently used by you in connection with the services rendered by MinkMe and/or Indian mesh.
MinkMe does not warrant that MinkMe service will operate without error or that the application and its servers are free of computer viruses.
MinkMe also does not warrant about the accuracy, completeness, reliability or timeliness of its content, services, software, text and/or links.
You agree that MinkMe has no liability or responsibility for the storage or deletion of any materials that you submit or post. MinkMe reserves the right to change these general practices and limits at any time in its sole discretion, with/without a notice
LINKS TO THIRD PARTY SITES
MinkMe contains links to third party sites that are not under the control of MinkMe and MinkMe is not responsible for any content on any linked site. If you access a third party service from MinkMe, then you do so at your own risk. Additionally, your dealings with or participation with other users of MinkMe, and any other terms (such as warranties) are solely between you and the user. You agree that MinkMe shall not be responsible for any loss or damage of any sort in context with your dealings.
USAGE OF TRADEMARKS AND COPYRIGHTS IN THE APP
Using of a Trademark and copyrighted image presented here is only for individual awareness and is not being used for commercial purposes. We are utilising these Trademarks and Copyrights to provide the users with app graphics. The users are not utilising inappropriate or altered graphics which actually harms the image of the brand and presents a wrong picture and sends out an inappropriate image.
In this way, we are promoting the brand value or image of the product.
The company is not liable for you using such graphics in your conversation and these are mainly presented to you so that you are aware of what the actual Trademark and copyright looks like.
If any of these Trademarks and Copyrights is owned by you and you believe that our mobile app is not utilizing the Trademark and Copyright in an inappropriate way or even if you believe that we should not use it, just send us an email and once we get the mail from you, your TM or Copyright that we are using as an image, would be immediately removed. This would be implemented only after we receive a legal email from you.
FEES PAYMENT
MinkMe reserves the right to charge listing fees for certain listings, as well as transaction fees based on certain completed transactions using the services. MinkMe further reserves the right to alter any and all fees from time to time, without notice.
The User shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of the use of the services.
In case, there is a short charging by MinkMe for listing, services or transaction fee or any other fee or service because of any technical or other reason, it reserves the right to deduct/charge/claim the balance subsequent to the transaction at its own discretion.
In the rare possibilities of the services not getting delivered for any reason whatsoever, we will process the refund and intimate you regarding the same.
ADVERTISERS ON MINKME OR LINKED WEBSITES
MinkMe is not responsible for any errors, omissions or representations on any of its pages or on any links or on any of the linked website pages. MinkMe does not endorse any advertiser on its web pages in any manner. The Users are requested to verify the accuracy on their own before relying on such information.
The linked sites are not under the control of MinkMe therefore MinkMe is not responsible for the contents of any linked site or any link contained in a linked site, or any changes or updates to such sites. MinkMe is providing these links to the users only as a convenience and the inclusion of any link does not imply endorsement of the site by MinkMe.
FORCE MAJEURE CIRCUMSTANCES
The User agrees that in situations due to any technical or other failure in MinkMe, services committed earlier (FOR BUSINESS CLIENTS ONLY), may not be provided or may involve substantial modification. In such cases, MinkMe shall refund the entire amount received from the customer for availing such services minus the applicable cancellation, refund or other charges, which shall completely discharge any and all liabilities of MinkMe against such non-provision of services or deficiencies. Additional liabilities, if any, shall be borne by the user.
SAFETY OF DATA DOWNLOADED
The user understands and agrees that any material and/or data downloaded or otherwise obtained through the use of the Service is done entirely at their own discretion and risk and they will be solely responsible for any damage to their computer systems or loss of data that results from the download of such material and/or data.
Nevertheless, MinkMe will always make its best endeavours to ensure that the content on its application, websites or other information channels are free of any virus or such other malwares.
FEEDBACK FROM CUSTOMER AND SOLICITATION
The user is aware that MinkMe would like to learn about him/her, to enhance his/ her experience with MinkMe. The user hereby specifically authorizes MinkMe to contact the user with offers on various services offered by it through direct mailers, e-mailers, telephone calls, short messaging services (SMS) or any other medium, from time to time. In case the customer chooses not to be contacted, he /she shall write to MinkMe for the same at contactus@indianmesh.com or inform his/ her respective service provider about his/her preferences.
PROPRIETARY RIGHTS
The design of MinkMe service along with MinkMe created scripts, graphics, interactive features, and the trademarks, service marks and logos are owned by MinkMe and Indian mesh, subject to copyrights and other intellectual property rights.
The user may use this material only as expressly authorized by MinkMe and shall not copy, transmit or create derivative works of such material without express authorization.
The user acknowledges and agrees that he/she shall not upload, post, reproduce, or distribute any content from the services protected by copyrights or other proprietary rights of a third party, without obtaining the written permission of the owner of such right.
Any copyright or other proprietary content distributed with the consent of the owner must contain the appropriate copyright or other proprietary rights notice. The unauthorized submission or distribution of copyrighted or other proprietary content is illegal and could subject the user to personal liability or criminal prosecution.
RIGHT TO CANCELLATION BY MINKME IN CASE OF INVALID INFROMATION FROM USER
The user expressly undertakes to provide MinkMe with correct and valid information while requesting for any services under this agreement. Any default on part of the user would vitiate this agreement and shall disentitle the user from availing the services of MinkMe
In case MinkMe discovers or has reasons to believe at any time during or after receiving a request for services from the user that the request for services is either unauthorized or the information provided by the user or any of them is not correct or that any fact has been misrepresented by him/her, MinkMe in its sole discretion shall have the unrestricted right to take any steps against the user(s) without any prior intimation.
The user unequivocally indemnifies MinkMe of any such claim or liability and shall not hold MinkMe responsible for any loss or damage arising out of measures taken by MinkMe for safeguarding its own interest and that of its genuine customers.
UPDATION OF THE INFORMATION BY MINKME
User acknowledges that MinkMe provides services with reasonable diligence and care. It endeavours to ensure that user does not face any inconvenience. However, some times, the information, software, products and services included in or available through the MinkMe application, websites or ad materials may include inaccuracies or typographical errors which will be immediately corrected as soon as MinkMe notices them. Changes are/may be periodically made/added to the information provided. MinkMe may make improvements and/or changes in the MinkMe application or websites at any time without any notice to the user. Any advice received except through an authorized representative of MinkMe via the MinkMe application or websites should not be relied upon for any decisions.
TERM AND TERMINATION
These Terms will remain in full force and effect while you are a user of MinkMe at any level. MinkMe reserves the right to pursue all of its legal remedies, including but not limited to removal of your content from the application and/or immediate termination of your registration upon a breach committed by you of these Terms and/or if MinkMe is unable to verify or authenticate any information you submit to MinkMe or Indianmesh.
JURISDICTION
MinkMe hereby expressly disclaims any implied warranties imputed by the laws of any jurisdiction or country other than those where it is operating its offices. MinkMe considers itself and intends to be subject to the jurisdiction only in the courts of Chandigarh, India.
