Welcome to Fon, by accessing the Fon Network you agree to be bound by these Terms of use of the Fon services (TOU) and Privacy Policy. Please read these TOU carefully, they affect your legal rights. If you do not agree to these TOU, you may not access the Fon service, so please refrain from using it.
Fon Wireless Limited (hereinafter, “Fon” “us”), is a company registered in the UK with company number 5661131 located at 25 Farringdon Street, London, EC4A 4AB, United Kingdom.
Fon is a Network linking user-provided wireless hotspots. By joining the Network, you gain access to Fon Spots across this global Network with a single registration.
I. Fon Services
Who is subject under this Terms of Use?
The TOU regulates the provision of services from Fon to the Fon Members and Fon Visitors, “You” or “you”.
The content, products, and services contained in the Fon Website are not designed or directed to persons resident in jurisdictions where such contents are not authorised or permitted.
Unless expressly stated otherwise, the present TOU together with the registration form, Fon’s Privacy Policy and, where applicable, Fon Software License Agreement and the Fon Application Software License Agreement, herein after “Agreement” shall constitute the contractual relationship between Fon and the Fon Member and between Fon and the Fon Visitor, where applicable.
You acknowledge that you have not relied on any other representations not specifically included in this Agreement. You represent that you are of legal age and have the legal capacity to enter into this Agreement. If you are contracting on behalf of a company, you represent that you are authorised to enter into this Agreement and agree to be personally liable for all accounts if you are not so authorised.
Who can access the Fon Spot?
In order to become a Fon Member or Fon Visitor you need to register with Fon and click the appropriate box to confirm you have read, understood, and accept the present TOU, the Privacy Policy and the other terms where applicable.
Fon Members shall have free access to any Fon Spot. Fon Visitors need to purchase a Fon Pass or may be granted with limited or unlimited access in virtue of a Fon promotion or specific agreement between Fon and a Third Party.
The Fon member or Fon Visitor shall, prior to access, have registered through Fon or through a Fon Partner to be allowed access to a Fon Spot.
The Fon Member shall ensure that its agreement with its broadband service ISP allows sharing of bandwidth. The Fon Member is the solely responsible for compliance with your contractual obligations towards such ISP.
Fon Account Registration
Our registration process will ask you for information including your name and other personal information. You must provide accurate and complete information in response to our questions. You must also keep the information that you provide up-to-date.
You must register with the Fon Network using the web form on our Site and Portal, providing full and correct information.
You will have the opportunity to choose a unique username, and you must remember this username or else store it in a safe place. You must keep your password secret and not divulge it or share it with others.
You have the obligation to immediately inform Fon as to any knowledge that you have regarding the improper use of the identifiers and/or passwords, including theft, loss, or unauthorised access, so as to immediately cancel the password/identifier. As long as Fon has not been informed of such, Fon shall be exempt of any liability derived from the improper use of the identifiers or passwords by unauthorised third parties.
You shall communicate to Fon any modifications of the information contained in your registration form as well as any subsequent modification of such information.
Any information or data collected or stored by Fon is subject to Fon’s Privacy Policy.
Description of Fon Services
The services provided by Fon consist of:
The Fon Members and the Fon Visitors can connect to the Fon Network through any Fon Spot when these are available.
To connect to the Fon Network, you will have to select a Fon Spot, and through the Fon Website or Fon Access Portal, introduce your username and password.
Fon will validate the data introduced by you and, subject to this Agreement, will permit you to connect to the Fon Spot.
Fon will notify you of any updates to the Fon Software whenever there is a new available version.
II. Fon Members
How can you become a Fon Member?
You can become a Fon Member by accepting this Agreement and owning a Fon Router, or a router of a Fon Partner, with the Fon functionality installed. If you do not have a router compatible with the Fon Software you may purchase a Fon Router through the Fon Website.
Installation and Activation of the Fon Software and Fon Spot
Once you have registered with the Fon Network as a Fon Member and accepted the Agreement, you may download, install, and use Fon Software. You agree to install Fon Software following the instructions provided in our manual published in our website. You accept and agree that Fon is not responsible for any failure or damage arising from the incorrect installation of Fon Software.
If you become aware of any aspect of Fon Hardware, Fon Software, or the Fon Service which has or is likely to cause damage, or allow damage to be caused, you will inform us promptly via the Fon Bug Tracking Form at support@fon.com.
The Fon Spot will be active and fully operational once the Fon Software or the Fon Router has been correctly installed and you have been registered.
Fon may publish information about the location of any Fon Spot the Fon Member registers within the Fon Network while this Agreement is in force. This is essential for other users to access the Service.
The Fon Visitor will be able to connect to the Fon Spots after registration to the Fon Network and payment of the Fon Pass as established in the Fon Visitor clause.
Rights and Obligations of the Fon Members
If you register as a Fon Member you understand that as a result of connecting a Fon Router to the Fon Network and registering with Fon, you will create a Fon Spot. Other users will be entitled to access the internet through this Fon Spot. In return for your providing and maintaining this facility in accordance with these TOU, you will be entitled to access all Fon Spots.
If you register as a Fon Member via owning a Fon Router you may activate and link your account to a PayPal account you will be entitled to receive a revenue share of any connection purchased through your Fon Spot by any Fon Visitor, but you will not be able to connect to other Fon Spots. Please note that this option is not available for all countries.
As a Fon Member you will not be able to connect simultaneously to several Fon Spots, but you will have the right to grant free access to your own Fon Spot to several users of your choice, the exact number of which shall be defined by Fon from time to time.
As a Fon Member, you agree to keep the Fon Spot active during 24 hours 7 days a week in order for the other Fon Members and Fon Visitors to be able to connect thereto.
In order to guarantee the correct functioning of the Fon Spots, the Fon Members shall exclusively use the official versions of the Fon Software.
You agree to use the Fon Services and accept to use them only for lawful purposes. If you use Fon Services for any unlawful purposes, or provide any unlawful or illegal content, or breach these TOU, Fon’s Privacy Policy, the Conditions for Use of the Fon Website and Fon Access Portal and the Users License of Fon Software, Fon may disconnect immediately your Fon Spot from the Fon Network and terminate this Agreement.
If you use the Fon Spot of a Fon Member to access the Internet, you agree not to use the Service to upload or download large files or make unfair use of the service in a manner that might cause impairment of the service for the Fon Spot owner or for the Fon Spot user.
III. Fon Visitors
In order to become a Fon Visitor, you will need: to register with Fon, purchase a Fon Pass through the available means of payment or be granted with limited or unlimited access in virtue of a Fon promotion, or a specific agreement between Fon and a Third Party.
The applicable rates are contained in the Fon Website and the Fon Access Portal. The Fon Visitor may obtain information on the applicable rates at any time through the Fon Website and the Fon Access Portal. These rates will include the relevant indirect taxes and any other charges where applicable and may vary from the country.
The means of payment for accessing Fon Services that a Fon Visitor may choose from shall be listed on the Fon Website and they will be offered through the registration process.
The Fon Visitor will pay Fon the corresponding amount for each Fon Pass.
Fon reserves the right to change, at any time, the prices, promotions, and/or discounts for the products and services that Fon provides. By continuing to use the Fon Service after the price change takes effect, you accept the new price.
You agree to use the Fon Services and accept to use them only for lawful purposes. If you use Fon Services for any unlawful purposes, or provide any unlawful or illegal content, or breach these TOU, Fon’s Privacy Policy, the Conditions for Use of the Fon Website and Fon Access Portal and the Users License of Fon Software, Fon may disconnect immediately your Fon Spot from the Fon Network and terminate this Agreement
All Fon Visitors are subject to the same obligations as the Fon Members where applicable.
IV. Fon Obligations
Fon will provide and control access to Fon Spots, authenticating and validating all Fon Members and Fon Visitors who connect through the Fon Spots.
Fon will register the number of users that access each Fon Spot and the type of user that has accessed each Fon Spot.
Fon agrees to pay the corresponding quantities to the Fon Members that activated and link their account to PayPal, where this option is permitted.
Quality of Service
Fon is unable to provide any warranties as to the levels of connectivity you will receive via your mobile, device or handset.
This may depend upon your location related to a Fon Spot. Connectivity fail to access may depend on your contract with a Fon Partner providing you limited access to the Network.
Fon cannot guarantee the access speed and the data transmission speed. Fon will not accept any responsibility for any connectivity issues you may experience.
Fon reserves the rights to suspend or revoke a Fon account should fraudulent misusage be detected.
Refund Policy
Fon shall guarantee that the authentication services it provides shall be available 80% during any 24 hour period. If the process of authentication is interrupted or it is reported an impairment of the purchased service, Fon shall refund the Fon Visitor for the non- usage of the daily Fon Pass.
Refund period shall expire 15 days after the Pass has been activated, in case of a multiple day-pass the last day Pass has been activated.
After the expiry of the refund period the Fon Visitor shall receive a Fon substitution Pass.
Obligations relating to Fon Members that link their account to PayPal
Any Fon Member of Fon who has enabled the option (where such option is available) to offer a Fon Spot in exchange for compensation will receive from and Fon shall pay the Fon Member a percentage of the net revenue of any Fon Pass purchased through the Fon Member Fon Spot, excluding indirect taxes and any other charges where applicable.
The Fon Member may obtain access to updated information on the applicable percentages of revenue sharing and any other rates through the Fon Website. These rates shall include the relevant indirect taxes and any other fees where applicable.
Payments to the shall be settled once the amount due to the Fon Member has accumulated and reached the predefined amount for settling said payments as published on the Fon Website.
Customer Care
Fon shall have a Customer Care Service available with the aim of responding to the queries related to the provision of Fon Services. If you are a Fon user you can contact the Customer Care Service writing to following E-Mail address: info@Fon.com
Any claim related to Fon Services should be addressed to the Customer Care Service, in written form, within a month of the date that the Fon user has become aware of the issue relating to the claim. The acceptance or rejection of the claim will be communicated to you within a month after its reception by Fon.
V. Intellectual and Industrial Property Rights
To preserve the uniform quality of Fon Services, you must use only the official versions of the Fon Software to provide access to our Fon Service.
Once the refund has been approved, you will receive your refund via the same means used to make your purchase, or via PayPal, at Fon’s discretion.
You accept that Fon and the Fon symbol, logos and graphics are trademarks of Fon and that Fon rights to this property are protected by law. You will immediately stop using the symbol, logos, and graphics when the Agreement is terminated.
You accept that the Hardware, Software, and Fon Service is protected by intellectual and industrial property laws and that Fon’s rights to this property are protected by law. You will observe the industrial and intellectual property rights, even after the termination of the Agreement.
You agree that any services containing proprietary content, information, and material that is protected by applicable intellectual property and other laws, including but not limited to copyright, and that you will not use such proprietary content, information or materials in any way whatsoever except for permitted use of the Services.
You recognise and accept that all the intellectual and industrial property rights, the Service, the content and/or whatever other element inserted in the Fon Website and Fon Portal (including, purely for information purposes and without limitation, brands, logotypes, texts, images, graphics, etc.) are protected by the applicable law. It is strictly forbidden to reproduce, distribute, publicly communicate, transfer, or whatever other act of exploitation that has not been expressly authorised by the holder of the operating rights.
No portion of the Services may be reproduced in any form or by any means. You agree not to modify, rent, lease, loan, sell, distribute, assign, copy, transfer, or transmit the Software, or any data obtained through the Software, to any third party or create derivative works based on the Fon Services, in any manner, and you shall not exploit the Fon Services in any unauthorised way whatsoever, including but not limited to, by trespass or burdening network capacity.
You further agree not to use the Services in any manner to harass, abuse, stalk, threaten, defame, or otherwise infringe or violate the rights of any other party, and that Fon is not in any way responsible for any such use by you, nor for any harassing, threatening, defamatory, offensive, or illegal messages or transmissions that you may receive as a result of using any of the Fon Services.
You agree that you will use the Fon Software and Trademark, and any data accessed through the Software, for your own personal non-commercial use only.
Your license to use the Software, its components, and any third-party data, will terminate if you violate these restrictions. If your license terminates, you agree to cease any and all use of the Software, its components, and any third-party data. All rights in any third-party data, any third-party software, and any third-party data servers, including all ownership rights, are reserved and remain with the respective third parties. You agree that these third parties may enforce their rights under this Agreement against you directly in their own name.
VI. Terms of use of the Fon Website
Access to the Fon Website is open and free of charge. Nevertheless, some of the services and content that Fon or third parties offer on this website may be subject to prior agreement or further agreements between Fon and its Partners.
Use of the Fon Website and linked web pages
Contents of the Fon Website are strictly for consumers. Any unauthorised commercial use or resale of the contents is prohibited, except with the prior, written and express authorisation of Fon.
Access, browsing, and use of the Fon Website are the responsibility of the user. Consequently, the user must diligently and faithfully observe all additional instructions given by Fon relating to the use of the website and its contents.
Therefore, the user is obliged to use the contents in a diligent and licit manner and, in particular, to abstain from the following:
Limitation of Liability for the Contents and Services
Fon offers content and services using all of the technical means that it has available to satisfy the needs of its users.
Fon will, as it deems necessary, make any changes, corrections, improvements or modifications to any information found on the Fon Website, to the services, or in the content without granting any right to claim or indemnification, or recognition of liability whatsoever.
Fon does not assume liability for any damage, injury, or loss of any kind as a result of the Fon Website’s availability or operations. Nevertheless, Fon shall take all necessary actions to reestablish its services in the event of any technical failure.
VII. Final Provisions
Terminating, changing, or transferring this Agreement
Either Fon or you may decide to end this Agreement at any time. If you wish to end this Agreement, you may do so by sending an email to unsubscribe@Fon.com or completing a form on the Website fifteen (15) days in advance to effective termination of the Service. Fon may terminate this Agreement at any time, for any reason, including but not limited to violation or evidence of violation of any of the terms and conditions herein. Furthermore, Fon may suspend or revoke access if Fon believes the Fon Member is in violation of the obligations or the spirit of these TOU.
If Fon wishes to end this Agreement, Fon will inform you by email at the email address you have registered with Fon. This Agreement will end immediately upon either party termination. However, Fon will continue to keep all your personal information confidential and you will continue to accept and respect Fon’s intellectual property rights.
Fon may decide to change this Agreement at any time. We expect that changes will be necessary as new features are added, and as characteristics and specifications are added to the Hardware, Software, and Service. We shall communicate any change to these T&Cs one month before any such changes enter into force. If you are unhappy with these changes, or if you feel these changes will affect you in a negative way, you are free to end this Agreement. Fon may terminate, suspend, or interrupt at any time without prior notice access to the contents of the Fon Website. The users shall have no right to indemnification for such. Fon shall be able to transfer or assign its position under this Agreement to any another entity of its group. The transferee shall therefore subrogate in all rights and obligations of Fon under this Agreement. You accept any of the said transfers and assignments.
Limitation of Liability
Fon shall only be liable under this Agreement for losses, which are a reasonably foreseeable consequence of the relevant breach of contract.
Fon shall not be liable for damages incurred by reason of other services or goods received through or advertised on the Fon Services or received through any links provided in the Fon Services, as well as by reason of any information or advice received through or advertised on the Fon Services or received through any links provided in the Fon Services.
Fon does not exclude or limit its liability in respect of (a) its wilful default or fraud; or (b) death or personal injury.
Severability
If any provision of this Agreement is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction, such provision shall be severed and the remainder of its provisions will continue in full force and effect as if this Agreement had been executed with the invalid, illegal, or unenforceable provision omitted.
Entire Agreement
This TOU together with Privacy Policy, and (where applicable the Fon Application Software License Agreement, the Fon Software License Agreement or the relevant additional terms that you accept as part of the registration process, new product or additional service) represents the final and entire agreement between you and Fon regarding the Service and products and supersede all previous agreements relating to the Service.
Jurisdiction and Law
This Agreement is subject to the laws of England, without regard to choice or conflicts of law principles and the parties hereby agree to submit to the exclusive jurisdiction of the English courts.
VIII. Definitions
Agreement means this Terms of Use, together with the registration form, Fon’s Privacy Policy and, where applicable, Fon Software License Agreement and the Fon Application Software License Agreement, and the Cookies Policy.
Fon Access Portal (or Fon Portal) is the portal used by Fon in Fon Spots through which a Fon Member or Fon Visitor can register and access the Fon Network.
Fon Hardware or Hardware: Hardware distributed by Fon or by a third party which will be used to connect to the Fon Network.
Fon Member is the registered user of Fon that shares bandwidth through a Fon Router or a router of a Fon Partner with the Fon functionality installed, in exchange for free connection to any Fon Hotspot of the Fon Network. Some Fon Members may have special rights and obligations.
Fon Network is the world-wide network of WLAN hotspots based on a community whose members share their broadband internet connection; these hotspots are either based on separate stand-alone Foneras or integrated with Customer Premises Equipment and provided as a best-effort service.
Fon Partner means a third party which has entered a partnership with Fon. Fon Partners are published in Fon Website.
Fon Pass(es) or Pass (es): Ticket that is purchased by a Fon Visitor in order to be able to access a Fon Spot.
Fon Router is the device distributed by Fon or its Partners and enabled with the Fon Software. Fonera, Fonera SIMPL, or Fonera for small business are brands of Fon Routers.
Fon Services or Services are the services provided by Fon that consist of providing access to the Fon Network, providing information about the location of the Fon Spot, authenticating and registering the Fon Members and Fon Visitors, and any additional service that Fon offers to the Fon Partner or the Fon Member.
Fon Software or Software: Software distributed by Fon or installed into the router of a Fon Partner that enables Fon Members to access the Fon Network.
Fon Spot means a public WLAN access point that belong to the Fon Network and that is operated by Fon, customers of Fon, or Fon Partners.
Fon Visitor is a registered user who does not offer a Fon Spot and who purchases and uses paid access to a FonSpot or is otherwise entitled to free limited or unlimited access in virtue of a Fon promotion or specific agreement between Fon and a Third Party.
Fon Website (or Site): Each and every one of the elements and contents of the website from which one can access the products and services provided by Fon.
Third Party means any person or entity that is not a party to this Agreement.
ISP means Internet service provider.
Wi-Fi means Wireless communications technology.
You and you: refer to you the Fon Member or Fon Visitor.

1. Registration data
When you sign up for the Fon Service, we may collect information we ask you for, like your username, password, e-mail address, date of birth, gender, postal code, and country. We may also collect information you voluntarily add to your profile, such as your mobile phone number and mobile service provider.
2. Store of your Data
Fon Wireless Ltd is the Data Controller of the data you are proving and fully complies with the current legislation regarding the protection of data of a personal nature, and with the confidentiality commitments characteristic of the activity that it undertakes. Furthermore, Fon complies with the UK Protection Act 1998, complementary regulation and other relevant legislation.
All of your personal data that Fon receives and stores shall be kept in a file called “Clients File”. The file is registered before the Information Commissioner’s Office with the registration number Z9433580. a company registered under the laws of England whose registered office is at 25 Farringdon Street, London, EC4A 4AB, United Kingdom and registered before the Registrar of Companies for England and Wales under the number 5661131 is solely responsible for this file. The data filed is adequate, appropriate and does not exceed the scope, purpose, and goals of the services that Fon provides.
3. How Fon uses and shares the information Fon collects
The purpose of this file is for Fon to better serve its users as well as to maintain contact with them. Fon may also use the data to send commercial information as well as for any other purpose Fon deems to be in the interest of its users, as explained herein.
We may share or use the information we collect, including your personal information for the above mentioned purposes to:
(i) provide, personalize, and improve your experience with the Fon Service. ensure technical functioning of the Service and products and services made available through the Fon Service, develop new products and services, and analyze your use of the Fon Service,
(ii) You agree and accept that the data you provide to Fon can be shared
(i) between companies of Fon ́s Group, subsidiaries and affiliates.
(ii) the Fon Partner in the country where the Fon Spot is located that provides the internet access powered by Fon for the provision of the service; Fon Partners will be published in the Fon Website.
(iii) to respond to legal process (e.g. a court order or authority request), if we believe in good faith that it is necessary to do so; to comply with requirements of mandatory applicable law; to protect the safety of any person and to address fraud, security or technical issues.
The treatment of personal data and its use for commercial communications purposes complies with the applicable legislation.
4. Payment data
When you purchase a Fon Pass or make other purchases through the Fon Service, your credit card, SMS or PayPal information and other financial data that we need to process your payment are collected and stored by third party payment processors, and we may collect some limited information, such as your postal code and details of your transaction history related to the Fon Service. These third parties generally provide us with some limited information related to you, and your card’s type, expiration date, and last four digits. The use of your data by our invoicing service provider is subject to its privacy policies.
5. Fon Spots location data will be published
While the Agreement is in place, Fon will publish the information relating to the Fon Spot location and address of all Fon Spots. This is indispensable for other Fon users to access the Fon Network.
You accept and agree that Fon needs to share the address of your access point to enable other Foneros to find it. You will contact us through our customer care support service if you want to edit the location information to make it less specific – for example, removing the apartment or suite number from an address, or giving a street number range (8 – 14 Main Street) rather than a precise number, and fuzz the geolocation data.
These fuzzed addresses will be visible in forms such as Fon maps and directories of nearby access points. We will not publicly associate your name with your address and access point, and we will not make your name or more specific address available to third parties. We cannot guarantee that third parties will not be able to deduce your precise address.
6. Worldwide Fon Spots’ Access and Security
Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable content. Fon Spots in different countries may be subject to differing local laws, and we may be required to store data to comply with those laws.
Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from your home nation, the country in which you reside, or any nation in which you are located when using the services. Those third countries and the applicable law may not ensure an adequate level of protection.
The access, data and information regarding such access through each Fon Spot is governed by the laws of the country where the Fon Spot is located.
Fon has adopted the technical measures necessary to maintain the security level required, according to the nature of the personal data processed and the circumstances of this processing, with the objective of avoiding (in the realm of the possible and always using the latest in technology) its alteration, loss, processing or non-authorized access.
7. Accessing to Third Party websites
Our Privacy Policy does not apply to any other company or to any other company’s websites or services even if you access them through Fon Spot.
If you disclose your personal information to other companies your information will be dealt with according to their privacy practices.
You understand that by using any of the Fon Services you agree to use the services at your sole risk and that Fon shall not have any liability to you or any other person for any third party services for content, service or products that may be deemed offensive, indecent, or objectionable, which content may or may not be identified as having explicit language, and that the results of any search or entering of a particular URL may automatically and unintentionally generate links or references to objectionable material.
You acknowledge and agree that Fon is not responsible for examining or evaluating the content, accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality or any other aspect of such third party Materials or web sites.
In addition, third party Services and third Party Materials that may be accessed from displayed on or linked to from Software are not available in all languages or in all countries. Fon makes no representation that such services and materials are appropriate or available for use in any particular location.
To the extent you choose to access such services or materials, you do so at your own initiative and are responsible for compliance with any applicable laws, including but not limited to applicable local laws.
Fon, and its licensors or Partners, reserve the right to change, suspend, remove, or disable access to any Fon Services at any time without notice.
In no event will the Fon be liable for the removal of or disabling of access to any such services.
This clause will survive at any termination of this Agreement.
8. Rights related to your data
You can exercise your rights to access, amend, delete and contest the data you have provided. Should you wish to notify us in this respect, send us your written request by email to: privacy@Fon.com. Do not forget to clearly state the right you wish to exercise.

Fon Software License Agreement Terms
This firmware that Fon Wireless Limited is providing for your use, is a set of programs [see below] developed under the GPL license, and it was distributed for installation in certain WIFI Linksys router models (i.e. WRT54G and WRT54GS).
“Firmware for the creation and administration of WIFI Access Points for the Fon Community”.
This firmware is free software. You may redistribute and/or change it according to the terms of the GNU GNU General Public License as published by the Free Software Foundation, in its current version 2.

Definitions
Terms and Conditions: These Terms and Conditions for the Sale of Equipment (hereinafter“TCSE”).
Fon Technology, S.L.: The Company that provides or sells the Products made available to the Customer through its web page, in all territories of the World with the exception of the United States (hereinafter “Fon”).
Fon US, Inc.: The Company that provides or sells the Products made available to the Customer through its web page in the United States territory (hereinafter “Fon”).
Products: All products offered, promoted and made available to the Customer through the Fon web page.
Customer: Any physical or legal person that purchases or acquires Fon Products through its web page.
Customer’s offer to buy: The Customer’s Order for the Product.
Promotion: Product offer with a discount from regular price, valid for a limited time period, and for a specific number of units.
Order Confirmation: Fon’s written acceptance of the Customer’s order.
Purchase Confirmation: Email sent by the Customer to Fon confirming all the purchase details, including the Customer’s personal data and data concerning the product being purchased.
Price: The total amount of money that the Customer has to pay to Fon to purchase or acquire the Products.
1. Scope
1.1. These TCSE will apply to all purchases of Fon Products made available through its web page.
1.2. These TCSE take precedence over any other conditions, unless such others have been expressly agreed between Fon and its Customers.
1.3. All Product orders will be considered as an offer by the Customer to purchase said Products in accordance with these TCSE.
1.4. Fon’s Confirmation of the Order to the Customer constitutes its acceptance of the Customer’s offer to purchase subject to these TCSE.
1.5. The Customer will be solely responsible for verifying the purchase according to Fon’s Confirmation of the Order and must inform Fon of any error or inaccuracy in said Order within 24 hours of receipt by Fon of the Order Confirmation. Fon will not have any responsibility for the delivery of any Product with which the Customer is not satisfied, which arises from any error or inaccuracy in the order, if the Customer has not informed Fon of any omission in any information referred to above.
2. Price and Payment Methods
2.1. The Price to be paid by the Customer for the Product acquired is the price established in Fon’s Order Confirmation, broken down into the Product price, taxes and delivery costs. The Product price must agree with the information provided in Fon’s web page.
2.2. The Price must take into account any difference in amount payable arising from the payment method chosen.
2.3. Payment for the purchase of the Product will be made prior to delivery of the Product, using any of the payment methods offered in the Fon web page.
2.4. Fon may suspend the delivery of the Product when it has not received payment in full for purchase of the same.
3. Delivery
3.1. The Product will be delivered to the address indicated by the Customer in the Order Confirmation and as verified in the Purchase Confirmation.
3.2. Fon undertakes to deliver the Product within 30 days following the Customer’s Purchase Confirmation. In the event that the delivery cannot be made within this period because the Product is not available, Fon must inform the Customer, who has the right to cancel the Contract and to receive reimbursement of the amount paid for said Product within 30 days.
3.3. Any loss, fault or damage howsoever arising in relation to the Product or packing must be advised by the Customer to Fon within fourteen (14) days from receipt of the product. If the Customer does not advise such loss, fault or damage in the product or packing within said period, the Customer will be responsible for all risk of damage or fault in the Product delivered.
3.4. Unless otherwise stated in the product promotion, the Customer shall be responsible for the delivery costs, which shall be duly identified and broken down in the Price.
4. Right to return or decline to accept the Product
4.1. If the Customer is not satisfied with the Product when it arrives, he may return it provided that he does so within fourteen (14) working days from the date of receipt. In order to return the Product, the Customer must indicate his intention to do so by sending an email to: shop@Fon.com
4.2. If the order has been dispatched, you may return the goods to us and we will organize a refund (excluding delivery cost).
4.3. Fon will not accept any product that has been used by the Customer or has been returned in an unacceptable or unserviceable condition. To this end, the Product must be returned without any damage whatsoever, in perfectly useable condition and in its original packaging.
4.4. Once the Product has been received in good condition, Fon will reimburse the Product Price to the Customer within thirty (30) days, via the payment method used to purchase the Product.
4.5. Any claim related to Fon Products shall be addressed, in writing, to the Customer Care Center, one month from the date the Fon customer identified the issue the claim is related to. The acceptance or denial of the claim will be communicated to the Customer one month after Fon receives it. Once Fon accepts the claim, Fon will have five (5) working days to settle the same.
5. Product’s Guarantees
5.1. Products sold by Fon through its web page will have a guarantee of two (2) years from the delivery date of said product. The day when the Customer receives the Product and signs the delivery statement is deemed to be the delivery date.
5.2. The Client must advise Fon of the non-compliance of the Product within a two (2) month time frame from the date he identifies the non-compliance.
5.3. Fon’s guarantee does not include failures produced by negligence, hits, or improper use or handling of the product by the Customer. The guarantee also does not cover the incorrect installation of the Product by the Customer, if he does not follow the directions provided by Fon or the Product’s manufacturer.
6. Limitation of Liability
Fon will not have any liability to its Customers: (i) For any delay in delivery of the Product, which is not Fon’s responsibility. (ii) For any damage to the Product caused by any act or omission of the Customer. (iii) For any damage to the Product caused by any improper changes made to the Product by the Customer. (iv) For any Product that is not in accordance with the Customer’s request, and where the Customer has not sent a Purchase Confirmation in accordance with Condition 1.5 of these TCSE. (v) Arising out of any incorrect usage of the Product by the Customer. (vi) For any defective Product when such defect arises as a result of unforeseen circumstances, accidents, humidity, electrical surges or any other environmental factors, and said defect has not been communicated to Fon by the Customer in accordance with Condition 3.3 of these TCSE.
7. Customer’s Obligations
7.1. The Customer undertakes at all times to provide true and accurate information as requested through the Fon web page when placing its Order, and to ensure that such information remains accurate.
7.2. The Customer agrees to accept, be bound by, and comply with all the provisions and conditions of these TCSE.
7.3. The Customer undertakes to enable the Product to be delivered and to provide Fon with an address where the Product can be delivered.
8. Confidentiality and Data Protection
8.1. Each party undertakes to treat all information received from the other as confidential.
8.2. All Customers’ personal data obtained by Fon will be treated and processed in accordance with Fon’s Privacy Policy available in its web page. Data provided by the Customer will be kept in an automatic filing system for personal data, created and maintained under the responsibility of Fon.
8.3. Fon may transfer personal data to other companies of the Fon Group, and to other companies hired by Fon to provide the services regulated by these TCSE, in accordance with its Privacy Policy (please read Fon’s Privacy Policy carefully).
8.4. Fon guarantees the security and confidentiality of all of its communications with its Customers. All on-line payments are made through a secure server and are protected against third-party interference.
9. Termination of the Contract
Either Party may terminate this Contract at any time in the event that the other Party fails to comply with these TCSE.
10. Severability
If any of these conditions is declared to be invalid, illegal or not applicable by any court of competent jurisdiction, said condition will be removed, but without rendering the whole Contract null or void and the rest of the conditions will remain in force and only those conditions which have been considered as invalid, illegal or not applicable shall be removed.
11. Applicable Law and Jurisdiction
Both parties expressly agree that Spanish law will govern this Contract. Any dispute arising between the Parties relating to the interpretation, execution or elimination of these TCSE will be submitted to the competent Courts and Tribunals to consider such matters as they apply to consumers, in the place where such obligation is to be carried out or the purchasing party’s place of domicile. If the purchasing party is domiciled outside Spain, both parties agree without exception to submit to the Jurisdiction of the Courts and Tribunals of the City of Madrid (Spain).
12. Miscellaneous
12.1. The Customer can find all information relating to the provision of the Fon Service, details of product Offers and information at: www.Fon.com.
12.2. Fon advises its Customers that accessing the file containing the electronic form of the contract constitutes proof that they have entered into the contract.
12.3. This Contract between Fon and the Customer will be expressed in English, Spanish, French or German language versions.
13. Unique terms applied to purchases in the United States
United States: This Contract applies between the Customer and Fon US, Inc., a Delaware incorporated company. This Contract will be bound, and so the Customer accepts, by the laws of New York. Both parties agree to be subject to New York’s courts and jurisdiction.

Your use of the Mobile Application
Welcome to the Fon Application Software (“the Software”) License Agreement, (“the Agreement”). This Agreement is between you (or any authorize user of the Software) and Fon, including its affiliates.
Fon allows its Partners’ (its actual or future “Fon Partner” as published in Fon’s website) customer to get access through this Software. Nothing in this Agreement modifies any of your conditions with your Internet Service Provider (“ISP”) or Fon Partner. Nevertheless, Fon and Fon Partner’s Terms of service should remain in force between you and Fon, or between you and the Fon Partner.
Fon allow you the right to download install and use the Software on your mobile handset or device to access the Fon service or Fon Partner’s service powered by Fon, in accordance with these terms and conditions.
In order to download and install the Software you must agree to the terms of this Agreement Furthermore, you are also bound by the Apps Store Terms of Service from where you have downloaded the Fon Application.
This Agreement is a legally binding contract that should be read in its entirety. If you disagree with any of the terms below, Fon doesn’t grant you a license to use the Software and you may not download it and should cancel or exit any installation you may have started.
This Agreement applies only for the Software License. Nothing in this Agreement implies any modification of the Terms of Service of Fon or the Terms of Service of the Fon Partner, as published in Fon or Fon Partner’s website. Declining this Agreement shall not impact on your ability to use other Fon or Fon Partner’s Services.
You agree that by installing the Software, you acknowledge you are at least 18 years old, have read this Agreement, understand it, and agree to be bound its terms.
Fon may change this Agreement at any time by posting a new version. Use of the Software after any such change constitutes your acceptance of such changes.
Fon shall use your current location through your mobile device only in order to show you the available hotspots near your location. Fon is not responsible for any Expenses relating to the connection to a Fon or Fon Partners powered by Fon WiFi Signal.
Wi-Fi hotspots are not owned or operated by Fon. Fon is not able to estimate upload or download speeds at these locations
Use and Restrictions
Software, documentation, and local electronic files installed or utilized by the installer application are owned by Fon, and are licensed to you by Fon on a worldwide (except as limited below), non- exclusive, non-sublicenseable basis on the terms set out in this Agreement. This Agreement defines legal use of the Software, all updates, revisions, substitutions, and any copies of the Software made by or for you.
All rights not expressly granted to you are reserved by Fon or their respective owners.
a. YOU MAY (i) install and personally use the Software and any updates provided by Fon (in its sole discretion) in object code form on a device owned or controlled by you and may use the Software for your own noncommercial use or benefit. Your license to use the Software under this Agreement continues until it is terminated by either party. You may terminate the Agreement by discontinuing use of any or all of the Software and by destroying all your copies of the Software. This Agreement terminates automatically if you violate any term of this Agreement, Fon publicly posts a written notice of termination on Fon’s web site, or Fon sends a written notice of termination to you.
b. YOU MAY NOT:
(i) decompile, reverse engineer, disassemble, modify, rent, lease, loan or distribute the Software (in whole or in part) or create derivative works or improvements of the Software or any portion thereof.
(ii) incorporate the Software into any component of or the firmware of any device manufactured by or for you.
(iii) use the Software in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with the terms of this Agreement.
(iv) use the Software to operate nuclear facilities, life support, or other mission critical applications where human life or property may be at stake. You understand that the Software is not designed for such purposes and that its failure in such cases could lead to death, personal injury, or severe property or environmental damage for which Fon is not responsible.
(v) use or export the Software in violation of applicable UK, or other relevant laws or regulations.
(vi) sell, lease, loan, distribute, transfer, or sub-license the Software or access thereto or derive income from the use or provision of the Software, whether for direct commercial or monetary gain or otherwise, without Fon’s prior, express, written permission. The foregoing is subject to applicable statute and other express law.
Ownership of the Software
Where the Software is protected by copyrights, trademarks, service marks, international treaties, and/or other proprietary rights and laws of the U.K. and other countries, you agree to abide by all such applicable proprietary rights laws and other laws, as well as any additional copyright notices or restrictions contained in this Agreement. Fon owns all rights, title, and interest in and to their applicable contributions to the Software. This Agreement grants you no right, title, or interest in any intellectual property owned or licensed by Fon, including (but not limited to) the Software or any Fon trademarks, and creates no relationship between you and Fon other than that of licensor to licensee.
Services and Third Party Materials
The Software may enable access to party services and web sites (collectively and individually, “Services”).
You understand that by using any of the Services that you may encounter content that may be deemed offensive, indecent, or objectionable, which content may or may not be identified as having explicit language, and that the results of any search or entering of a particular URL may automatically and unintentionally generate links or references to objectionable material. Nevertheless, you agree to use the Services at your sole risk and that Fon shall not have any liability to you for content that may be found to be offensive, indecent, or objectionable.
Certain Services may display, include or make available content, data, information, applications or materials from third parties (“Third Party Materials”) or provide links to certain third party web sites. By using the Services, You acknowledge and agree that Fon is not responsible for examining or evaluating the content, accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality or any other aspect of such Third Party Materials or web sites. Fon does not warrant or endorse and does not assume and will not have any liability or responsibility to you or any other person for any third-party Services, Third Party Materials or web sites, or for any other materials, products, or services of third parties.
You agree that any Services contain proprietary content, information and material that is protected by applicable intellectual property and other laws, including but not limited to copyright, and that You will not use such proprietary content, information or materials in any way whatsoever except for permitted use of the Services. No portion of the Services may be reproduced in any form or by any means. You agree not to modify, rent, lease, loan, sell, distribute, or create derivative works based on the Services, in any manner, and you shall not exploit the Services in any unauthorized way whatsoever, including but not limited to, by trespass or burdening network capacity. You further agree not to use the Services in any manner to harass, abuse, stalk, threaten, defame or otherwise infringe or violate the rights of any other party, and that Fon is not in any way responsible for any such use by you, nor for any harassing, threatening, defamatory, offensive or illegal messages or transmissions that you may receive as a result of using any of the Services.
In addition, third party Services and Third Party Materials that may be accessed from, displayed on or linked to from Software are not available in all languages or in all countries. Fon makes no representation that such Services and Materials are appropriate or available for use in any particular location. To the extent you choose to access such Services or Materials, you do so at your own initiative and are responsible for compliance with any applicable laws, including but not limited to applicable local laws. Fon, and its licensors or Partners, reserve the right to change, suspend, remove, or disable access to any Services at any time without notice. In no event will the Fon be liable for the removal of or disabling of access to any such Services. The Application Provider may also impose limits on the use of or access to certain Services, in any case and without notice or liability.
You agree that you will use the Software, and any data accessed through the Software, for your own personal non-commercial use only. You agree not to assign, copy, transfer, or transmit the Software, or any data obtained through the Software, to any third party. Your license to use the Software, its components, and any third-party data, will terminate if you violate these restrictions. If your license terminates, you agree to cease any and all use of the Software, its components, and any third-party data. All rights in any third-party data, any third-party software, and any third-party data servers, including all ownership rights are reserved and remain with the respective third parties. You agree that these third parties may enforce their rights under this Agreement against you directly in their own name.
This clause will survive at any termination of this Agreement.
Support, Software Updates & Availability
While Fon have tried to get a broad coverage of mobile devices, Fon Software will not work on all mobile handsets. Download and operation success may depend on handset settings.
Fon may elect to provide you with customer support and/or software upgrades, enhancements, or modifications for the Software (collectively, “Support”), in its sole discretion, and may terminate such Support at any time without notice to you. Fon may change, suspend, or discontinue any aspect of the Software at any time, including the availability of any Software feature, database, or content. Fon may also impose limits on certain features and services or restrict your access to parts or all of the Software or the Fon Applications web site without notice or liability.
Additionally, for certain versions of the Software, in order to enhance the security of the Software or to fix bugs, from time to time, Fon may automatically download and install updates to the Software with or without prior notification.
From time to time Fon may automatically download the latest version of the Software and notify you when it’s ready to install. Downloads of the Software may be limited by your ISP or network. If you wish to update your Software, you must agree to the terms of the then current Agreement, in order for the update to be installed on your device. Fon is solely responsible for the maintenance and support of this application.
Fon is able to suspend access to service through the Software. Fon can do this for any reason, but will usually only do so when carrying out maintenance on the Software or the systems supporting it.
Data Charges and access
You recognize that the search engine to find a hotspot require the access data. Unless otherwise set forth, Fon doesn’t charge for the service but your operator may apply any rate.
Data access charges may be charged to you by your network provider depending on your individual tariff. You are responsible for any such costs. Note that if you intend to use the Software on an overseas network, the cost of data usage may be considerably higher than when at home
Fon is unable to provide any warranties as to the levels of connectivity you will receive via your mobile handset. This may depend upon your tariff, your Agreement with a Fon Partner or your network provider, your handset and your location related to a Hotspot. Connectivity fail to access may depend on your contract with a Fon Partner providing you a limited access to the Network.
Fon will not accept any responsibility for any connectivity issues you may experience.
This clause will survive at any termination of this Agreement.
Disclaimer of Warranties:
Use of the Software is at your sole risk and is provided on an “as is” basis.
Fon, its officers, directors, employees, contractors, agents, affiliates, and assigns (collectively, “Fon Entities”), expressly disclaim all warranties of any kind, whether express or implied, relating to the Software and any data accessed there from, or the accuracy, timeliness, completeness, or adequacy of the Software and any data accessed by using it, including the implied warranties of title, merchantability, satisfactory quality, fitness for a particular purpose, and non-infringement.
If the Software or any data accessed by using it proves defective, you (and not the Fon Entities) assume the entire cost of all repairs or injury of any kind, even if the Fon Entities have been advised of the possibility of such a defect or damages.
Limitation of liability
Notwithstanding any other provision, nothing in this Agreement shall exclude or limit either party’s liability for the tort of deceit, fraudulent misrepresentation, death or personal injury caused by negligence.
Fon will not be liable to you for claims and liabilities of any kind arising out of or in any way related to the use of the Software by yourself or by third parties.
Fon is not liable to you for any and all direct, incidental, special, indirect, or consequential damages arising out your use or inability to use or access the Software, or any data provided through the Software, whether such damage claims are brought under any theory of law or equity. Damages excluded by this clause include, including but not limited to, your personal computer equipment or software, losses or injury to your business or data, or damages, including lost income or business opportunity relating to or caused, directly or indirectly by, service failures, equipment or underlying line failures, by any failures
Information provided through the Software may be delayed, inaccurate, or contain errors or omissions, and Fon will have no liability with respect thereto. Fon may change or discontinue any aspect or feature of the Software or the use of all or any features or technology in the Software at any time without prior notice to you.
No General Waiver; Severability.
If any provision in this Agreement shall be held to be illegal, invalid or unenforceable, in whole or in part, under any enactment or rule of law or otherwise, such provision (or part) shall to that extent be deemed not to form part of this Agreement but the legality, validity and enforceability of the remainder of this Agreement shall not be affected.
This Agreement constitutes the entire agreement and understanding between the parties in respect of the Software and supersedes all previous agreements, understandings and undertakings, in such respect. This Agreement and the relationship between you and Fon are governed by the laws of England and Wales without regard to its conflict of law provisions. You and Fon agree to submit to the personal and exclusive jurisdiction of the courts located within England and Wales.

The Terms and Conditions of Fon or the Terms and Conditions of a Fon Partner previously accepted by you, shall remain in full force and effect. Nothing in this Legal Notice implies any modification of those Terms and Conditions. To the extent that there is a conflict between any provision of this Legal Notice and the Terms and Conditions of Fon or a Fon Partner, such Terms and Conditions shall apply.
This Legal Notice should be read in its entirety. It is your responsibility to read it. If you disagree with any of the terms below, you should not access this Service.
In virtue of this Legal Notice Fon informs you that:
1. Access to this Fon Spot
Fon shall use your current location, gained through your mobile or device, only in order to show you available Fon Spots near your location. Fon is not responsible for any expenses relating to the connection to a Fon or Fon Partner powered by the Fon WiFi Signal.
2. Personal Access Data
Fon will use your personal data only to provide you Access to the Service through Fon or through the Fon Partner Service. You are duly informed and accept that, in order to be able to provide Access to this Fon Spot, Fon has the right to collect and process your personal information and share it with the Fon Partner through which you have been registered to access to the Fon Service, Otherwise, Fon will not obtain or share your personal data and will only disclose it when required by law, by any competent regulatory authority or by a court of competent jurisdiction.
3. Quality of Service
Wi-Fi Fon Spots are not owned or operated by Fon. Fon is not able to estimate upload or download speeds at these locations.
Fon is unable to provide any warranties as to the levels of connectivity you will receive via your mobile or device. This may depend upon your tariff, your Agreement with a Fon Partner or your network provider, your handset and your location related to a Fon Spot. Connectivity failure to access may depend on your contract with a Fon Partner providing you a limited access to the Network.
Fon will not accept any responsibility for any connectivity issues you may experience.
4. Intellectual Property Content
You understand that any Services containing proprietary content, information and material that is protected by applicable intellectual property and other laws, including but not limited to copyright, logos, trademark and that you will not use such proprietary content, information or materials in any way whatsoever except for permitted use of the Services. No portion of the Services may be reproduced distributed, transferred, exploited or whatever other act in any form or by any means that has not been expressly authorized by the holder of the operating rights. You agree not to modify, rent, lease, loan, sell, distribute, or create derivative works based on the Services, in any manner, and you shall not exploit the Services in any unauthorized way whatsoever, including but not limited to, by trespassing or burdening network capacity. You further agree not to use the Services in any manner to harass, abuse, stalk, threaten, defame or otherwise infringe or violate the rights of any other party, and that Fon is not in any way responsible for any such use by you, nor for any harassing, threatening, defamatory, offensive or illegal messages or transmissions that you may receive as a result of using any of the Services.
In addition, to the extent you choose to access any Services or Materials, you do so at your own initiative and you are responsible for compliance with any applicable law, including but not limited to applicable local law.
Fon, and its licensors or Partners, reserve the right to change, suspend, remove, or disable access to any Services at any time without Legal Notice. In no event will Fon be liable for the removal of or disabling access to any such Services.
Fon and Fon Partner do not warrant or endorse and do not assume and will not have any liability or responsibility to you, or any other person, for any third party services or third party materials.

Welcome to Fon, by registering your Fon router You are joining the Network and You agree to be bound by these Terms of use of WiFi for Business Service, hereinafter “Agreement”. Please read this Agreement, it may affect your legal rights. If You do not agree to this Agreement, You may not access the Fon service, so please refrain from using it.
Fon Wireless Limited (hereinafter, “Fon” “us”), is a company registered in the UK with company number 5661131 located at 25 Farringdon Street, London EC4A 4AB, United Kingdom.
This Agreement together with the Terms and conditions, Privacy Policy and other terms that the WiFi for Business Member (or “You”) have accepted when registering and creating your Fon or Partner’ account allows You to access this Service and be part of the Fon Community
You become a WiFi for Business Member by accepting this Agreement, having a Fon Account and owning a Fon Router or a router of a Fon Partner with the Fon functionality for WiFi for Business service installed.
The terms and conditions of Fon or the terms and conditions of a Fon Partner previously accepted by you, shall remain in full force and effect. Nothing in this Agreement implies any modification of those Terms and Conditions. This Agreement shall apply to the Fon Service provided as a WiFi for Business Member.
You shall activate your Fon Router in order to create a FonSpot.
If You become aware of any aspect of Fon Hardware, Fon Software, or the Fon Service which has or is likely to cause damage, or allow damage to be caused, you will inform us promptly via the Fon Bug Tracking Form at info@fon.com.
Fon will publish information about the location of your Fon Spot within the Fon Network while this Agreement is in force. This is essential for other users to access the Service.
The Fon Visitor will be able to connect to the Fon Spots after registration to the Fon Network, for the time and/or under the payment conditions, (e.g. Pass) set forth on the customized Fon Portal and previously agreed by Fon.
WiFi for Business Member shall have the right:
· to customize the Fon Portal by uploading the any branded images and promotional materials in the space reserved by Fon for this purpose.
· to provide Fon Visitors a limited free access as decided by Fon or by the WiFi for Business Member
· to receive be informed about the use of the Fon Service and products advertised through the Fon Access Portal of its Fon Spot.
· If You register as a WiFi for Business Member You understand that as a result of connecting a Fon Router to the Fon Network and registering with Fon, You will create a Fon Spot. Other users will be entitled to access the Internet through this Fon Spot.
· WiFi for Business Member agrees to keep the Fon Spot active during 24 hours 7 days a week in order for the other Fon Members and Fon Visitors to be able to connect thereto.
· In order to guarantee the correct functioning of the Fon Spots, the WiFi for Business Member shall exclusively use the official versions of the Fon Software.
· WiFi for Business Member shall check if it is permitted to share your bandwidth in accordance with its ISP user agreement as the WiFi for Business Member is the sole responsible for compliance with the contractual obligations towards such ISP.
· WiFi for Business Member agrees to use the Fon Services and accept to use them only for lawful purposes. If you use Fon Services for any unlawful purposes, or provide any unlawful or illegal content, or breach these TOU, Fon’s Privacy Policy, the Conditions for Use of the Fon Website and Fon Access Portal and the Users License of Fon Software, Fon may disconnect immediately your Fon Spot from the Fon Network and terminate this Agreement.
· Respect the intellectual property rights of others. Do not use business names and/or logos in a manner that can mislead, confuse, or deceive users. WiFi for Business Member shall be the sole responsible of any Intellectual Property infringement contained in the customized Portal.
· WiFi for Business Member can only advertise its own products and services in the reserved space on the Fon Portal, and shall not resell or trade such space without Fon’s prior consent. Fon is not responsible for the use by WiFi for Business Member of third party’s intellectual property.
· WiFi for Business Member shall not confuse or mislead users about the purpose of your advertisement in the Fon Portal.
· WiFi for Business Member shall ensure that the content they upload to the Fon Portal is conforming to all local laws and regulations.
· WiFi for Business Member shall not facilitate or encourage the publishing of malicious content or pornographic or obscene images or any other content not suitable for public display in their country, as well as links to such content.
· WiFi for Business Member shall not use the customized Fon Portal as a site intended to entice or encourage users to violate the Fon Agreement such as a spam or malware site.
· WiFi for Business Member shall not facilitate or encourage the publishing of private or confidential information, through the Fon Access Portal.
· WiFi for Business Member will not challenge Fon’s ownership of, the validity of any license to use or otherwise copy or exploit the Fon Trademark during or after the termination of this Agreement except as specifically authorized herein.
Any rights not expressly granted herein are withheld. Fon may suspend or revoke access if Fon believes the WiFi for Business Member is in violation of the obligations or the spirit of these TOU.
The services provided by Fon consist in providing and controlling access to Fon Spots, authenticating and validating all Fon Members and Fon Visitors who connect through the Fon Spots.
· facilitating access to the Fon Spots, providing the authentication and registration for such access.
· providing information about the location of the different Fon Spots.
· registering the number of users that access each Fon Spot and the type of user that has accessed each Fon Spot such as Fon Visitor, Fon Member or WiFi for Business Member.
· offering access to the Fon Spots to the Fon Members.
· offering services to the Fon Members and WiFi for Business Members.
Fon is unable to provide any warranties as to the levels of connectivity that a Fon Member or Fon Visitor will receive via your mobile, device or handset.
This may depend upon the location of the user related to a Fon Spot. Connectivity fail to access may depend on your contract with a Fon Partner or ISP providing You a limited access to the Network.
Fon cannot guarantee the access speed and the data transmission speed. Fon will not accept any responsibility for any connectivity issues You may experience.
Fon may reserve the rights to suspend a WiFi for Business Member’sFonSpot in case a fraudulent misusage is detected.
Fon shall have a Customer Care Service available with the aim of responding to the queries related to the provision of Fon Services. If You are a Fon user You can contact the Customer Care Service writing to following E-Mail address: info@Fon.com
Any claim related to Fon Services should be addressed to the Customer Care Service, in written form, within a month of the date that the Fon user has become aware of the issue relating to the claim. The acceptance or rejection of the claim will be communicated to You in a month after its reception by Fon.
Terminating, changing or transferring, this Agreement
Either Fon or You may decide to end this Agreement at any time. If You wish to end this Agreement, You may do so by sending an email to unsubscribe@Fon.com or completing a form on the Website fifteen (15) days in advance to effective termination of the Service. Fon may terminate this Agreement at any time, for any reason, including but not limited to violation or evidence of violation of any of the terms and conditions herein. If Fon wishes to end this Agreement, Fon will inform You by email at the email address You have registered with Fon.This Agreement will end immediately upon either party termination. However, Fon will continue to keep all your personal information confidential and You will continue to accept and respect Fon’s intellectual property rights.
Fon shall be able to transfer or assign its position under this Agreement to any another entity of its group. The transferee shall therefore subrogate in all rights and obligations of Fon under this Agreement. You accept any of the said transfers and assignments.
Limitation of Liability
Fon shall only be liable under this Agreement for losses, which are a reasonably foreseeable consequence of the relevant breach of contract.
Fon shall not be liable for damages incurred by reason of other services or goods received through or advertised on the Fon Services or received through any links provided in the Fon Services, as well as by reason of any information or advice received through or advertised on the Fon Services or received through any links provided in the Fon Services.
Fon does not exclude or limit its liability in respect of (a) its willful default or fraud; or (b) death or personal injury.
Severability
If any provision of this Agreement is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction, such provision shall be severed and the remainder of its provisions will continue in full force and effect as if this Agreement had been executed with the invalid, illegal or unenforceable provision omitted.
Entire Agreement
This Agreement together with the Terms of Use of Fon, the Privacy Policy, and (where applicable the Software License Agreement or the relevant additional terms that You accept as part of the registration process, new product or additional service) represents the final and entire agreement between You and Fon regarding the Service and products and supersede all previous agreements relating to the Service.
Jurisdiction and Law
This Agreement is subject to the laws of England, without regard to choice or conflicts of law principles and the parties hereby agree to submit to the exclusive jurisdiction of the English courts.
Agreement means this terms of use, together with the registration form, Fon’s Terms of Use, Fon’s Privacy Policy and, where applicable, Fon Software License Agreement and the Fon Application Software License Agreement and the Cookies Policy.
Fon Access Portal (or Fon Portal) is the portal used by Fon in Fon Spots through which Fon Member or Fon Visitor can register and access to the Fon Network.
Fon Hardware or Hardware: Hardware distributed by Fon or by a third party which will be used to connect to the Fon Network.
Fon Member is the registered user of Fon that shares bandwidth through a Fon Router or a router of a Fon Partner with the Fon functionality installed, in exchange for free connection to any Fon Hotspot of the Fon Network. Some Fon Members may have special rights and obligations.
WiFi for Business Member is a Fon Member who has purchased a Fonera for small business, or any other similar device or customizable Fon Router offered by Fon or by a Fon Partner. The WiFi for Business Member provides free access to its customers and shall have in addition to the Fon Member further rights and obligations
Fon Network is the world-wide network of WLAN hotspots based on a community whose members share their broadband internet connection; these hotspots are either based on separate stand-alone Foneras or integrated with Customer Premises Equipment and provided as a best-effort service.
Fon Partner means a Third party which has entered a partnership with Fon. Fon Partners are published in Fon Website.
Fon Pass(es) or Pass (es): Ticket that is purchased by a Fon Visitor in order to be able to access Fon Spot.
Fon Router is the device distributed by Fon or its Partners and enabled with the Fon Software. Fonera, Fonera SIMPL or Fonera for small business are brands of Fon Routers.
Fon Services or Services are the services provided by Fon consist of providing access to the Fon Network, providing information about the location of the Fon Spot, authenticating and registering the Fon Members and Fon Visitors, and any additional service that Fon offers to the Fon Partner or the Fon Member.
Fon Software or Software: Software distributed by Fon or installed into the router of a Fon Partner that enables Fon Members to access to the Fon Network.
Fon Spot means a public WLAN access point that belong to the Fon Network and that is operated by Fon, customers of Fon or Fon Partners.
Fon Visitor is a registered user who does not offer a Fon Spot and who purchases and uses paid access to a FonSpot or is otherwise entitled to free limited or unlimited access in virtue of a Fon promotion or specific agreement between Fon and a Third Party.
Fon Website (or Site): Each and every one of the elements and contents of the website from which one can access the products and services provided by Fon.
Third Party means any person or entity that is not a party to this Agreement.
ISP means Internet service provider.
Wi-Fi means Wireless communications technology.
You and you: refer to you the Fon Member or Fon Visitor.

Use and Access of the Fon App and Purchasing an Access Pass through the Fon App.
Welcome to the FonApp. This end user agreement, hereinafter (“End User Agreement”) informs you about the terms of the service provided through this app “FonApp”.
The FonApp will enable you to connect to the FonSpots worldwide upon the payment of a recurrent subscription, “Service”.
By downloading or using the app, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app.
Fon is offering you this app to use for your own personal use, but you should be aware that you cannot send it on to anyone else, and you’re not allowed to copy, or modify it. The Fon Application Software License Agreementwill apply to the FonApp.

QUALITY OF SERVICE AND LIABILITY
Fon is committed to ensuring that the FonApp and the Service are as useful and efficient as possible. For that reason, Fon reserves the right to make changes to the FonApp at any time and for any reason.
If you download the FonApp outside of an area with WiFi, you should remember that your terms of agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing or downloading the FonApp, or other third party charges.
In using the FonApp, you’re accepting responsibility for any such charges if you are not duly connected to the FonSpot through the Fon App, including roaming data charges when using FonApp or the Service outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the FonApp, please be aware that Fon assumes that you have received permission from the bill payer for using the Fon App.
PAYMENTS, CANCELLATIONS AND TERMINATION OF THIS END USER AGREEMENT
If you reside in country which is part of the European Union and have purchased a subscription Fon Pass through the Fon App, you have the right to change your mind and receive a full refund within fourteen (14) days of purchase hereinafter the “Coolingoff Period”, but only if you have not logged in or otherwise redeemed or started to consume the Paid Subscription. You must send your communication of cancellation before the 14day period has expired to unsubscribe@fon.com.
The payment of the Fon App will be done through a third party store or market platform “Third Party Platform” such payment will be done by a way of recurring payment subscription hereinafter “Paid Subscription”.
The payment to Fon will automatically renew at the end of the subscription period, unless you cancel your Paid Subscription through your subscription page or you direct to the subscription option to cancel the activation or any other way set for this purpose within the Third Party Platform in any case before the end of the current subscription period. Alternatively you could send us an email to unsubscribe@fon.com.Any termination, after the Coolingoff Period is over, will take effect two days day after the cancellation.
Fon will not refund any Paid Subscription already paid after the Coolingoff Period and the Service will be provided until the last day of the current subscription period. From the next day of the last day of the current Paid Subscription the payment will be not be charged.
Fon may change the price for the paid subscriptions from time to time, and will communicate any price changes to you. Price changes for Paid Subscriptions will take effect at the start of the next subscription period following the date of the price change. By continuing to use the Service after the price change takes effect, you accept the new price.
Fon reserves the right to modify, suspend, discontinue or terminate the Service and this End User Agreement at its sole discretion and Fon will not be liable to you or to any third party. To the extent possible, Fon will warn you in advance of any modification, suspension, discontinuance or termination of the Service or the Agreement. Termination of the Service will not affect the Paid Subscriptions that you have already acquired until the end of the subscription period.
In anything not contained in this End User Agreement, the Third Party Platform terms shall apply.
