    Because stalking someone to their court date rly disrupts the court system, its been v long established that you can't serve someone or initiate a civil arrest if they're attending court. This legal principle is older than ICE, and also like, the Mayflower

    A8: This is one of the hardest things to advise about: ICE is still arresting people using the courthouse trap. The judicial warrant requirement places a tiny limit on a huge problem. We need more.

    YES, this is why NYS must pass the Protect Our Courts Act: ICE agents continue to come to courts to follow and ID non-citizens throughout the building (unbeknownst to them) and then arrest them soon as they step outside the courthouse

    A10 The Act will help ensure court access for ALL New Yorkers, regardless of immigration status. It makes it unlawful for ICE to make civil arrests while a person is going to, attending, or leaving court unless they present a judicial warrant or court order. 1/3

    We can pass the ! and I carry legislation to prohibit ICE agents from making civil arrests in and around New York State courthouses without a judicial warrant or court order. It's important that we enshrine this principle into law!

    A7: After 2 yrs of advocacy NYS Office of Court Administration became first state court administration to promulgate rules barring ICE from making arrests in courthouses & area unless they have judicial arrest warrant or court order. They never have a court order!

    A4: ICE can and does use courthouses as a trap! Outrageous right? We have to do more than say the word "sanctuary" to protect immigrants. In NY, our policies aren't enough. Actually let me say, not enough yet! We're working on putting an end to this.
