    This will likely trigger more cases in the future. I myself still find it confusing to know when this is the case. Don't data transfers always involve terminal equipment at some stage?

    Interesting: the COM had argued that only consent could be a valid ground of lawful processing in light of the e-privacy directive as what is at stake is information located on terminal equipment. The Court leaves this to the national court to decide, leaving this unanswered.

    All in all a not very surprising decision. Some thoughts: it will be interesting to see what practical implications this will come to have. How will websites enforce this? More 'cookie notices', better and more clever design, something else?
