    Not how any of this works.

    Trump just signed the executive order regarding social media. Twitter may lose its Section 230 protections because they're editorializing posts and acting as political activists.

    Quite a day for me. Here I'm in 100% agreement with Mary Anne on an issue related to Section 230. I assure you this has probably never happened before.

    The text of the order is available now. It's exactly as opportunistic, constitutionally illiterate, Orwellian, and deliberately designed to distract from Trump's atrocities as one might expect.

    The executive order re: Section 230 is premised on an incorrect reading of Section 230. It's............... just a new and different law that never existed before. One that wasn't passed by the legislature.

    Look it’s not that I’m unaware of how unconstitutional and authoritarian this Executive Order is - it’s just that he’s pretty clearly doing this particular unconstitutional authoritarian thing because he doesn’t want people talking about his botched pandemic response.

    Between the draft and the final result, the White House removed a reference to the media having free speech rights. Bit on the nose, ain't it?

    It also modifies the passage about his demonstrated respect for free speech in various venues and its importance for democracy. Guess which is missing.

    Today's nonsense was yet another example where a bipartisan majority of experts know a Trump proposal is just rushed nonsensical bullshit, but everybody (including the press) helped him portray it as serious adult policy. maybe there's a lesson there?

    A really good read. And it's worth noting that it's now a common tactic for regulators and companies to point to big tech's bad behavior when their own is under scrutiny. .

    Our latest Tech Policy Greenhouse entry comes from who is quite rightly concerned about how to protect our privacy, but wonders why all the focus is on a small set of companies who don't even appear to be the worst actors.
