    9th Circuit just held that digital services aren’t required to pay for performing pre-1972 sound recordings under California law. Holds that California’s law doesn’t include public performance right.

    False advertising law treats consumers as sophisticated and able to navigate uncertainty. Trademark law? It’s possible 5% of consumers will think some crazy thing. We must stop that.

    9th Circuit: Trader Joe's "100% New Zealand Manuka Honey" will not mislead consumers to think that the honey is 100% derived from Manuka honey.

    This needs lots more attention.

    This is a really important 🧵on entry into the legal academy. I entered the academy in 2006, after two years in a fellowship that paid around $32K (in NYC). It was ... not a lot. I wouldn't have been able to do it (and then get a great job ) if I hadn't been married.
