I can't recall another case in which a state appeals court upheld a conviction when both the defense and state AG asked it to be overturned, with no opposition from the DA.
We've seen a few with a new DA/defense on one side, and a state AG on the other.

Bill language being floated doesn't allow ex parte hearings and instead requires court hearings to be scheduled within 3-5 days of law enforcement filing a petition alleging threat of substantial harm. Whether that's enough to alleviate GOP objections to ERPOs remains to be seen

The next 48-hour stretch is likely make or break for this. Lawmakers are coming in after lunch to take up the budget. Lawmakers could, of course, choose to extend their time in Nashville to deal with this, but that certainly doesn't seem likely at this point.
